Guidelines
What does it mean to provide notice?
Providing notice means that the employer notifies the employee that they will be leaving their job after some set period of time, such as 2 weeks. The employee still has their job during that period of time, and therefore, continues to work.
What does it mean to provide pay in lieu of notice?
Providing pay in lieu of notice means that the employer pays to the employee some amount of their wage to compensate for a shorter notice period. The pay in lieu of notice could be for all of the notice period, or just part of it. The employee would not continue to work during a period where they are receive pay in lieu of notice.
Do I have to provide notice?
Statutory law requires the employer to provide notice, or pay in lieu of notice, where the employee is terminated without just cause. If the employment contract requires notice for terminating without cause, the employer must provide to the employee the greater of the notice or pay in lieu of notice.
